Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, subscribing to, or using Caloblock, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Caloblock.

These Terms form an agreement between you and Ofri Cohen, operating Caloblock ("Caloblock", "we", "our", or "us").

2. Accounts, Eligibility, and Age Requirement

You may create or access a Caloblock account using email, Google Sign-In, or Apple Sign-In. You are responsible for providing accurate information, maintaining the confidentiality of your credentials, and all activity associated with your account.

You may not use Caloblock if you are prohibited from doing so under applicable law or if you are below the minimum age required by applicable law or platform rules. If you are under the age required to use online services in your location, you may use Caloblock only where permitted by law and, where required, with appropriate parental or guardian consent.

3. Subscriptions, Billing, and Payments

Caloblock may offer premium features through monthly and yearly auto-renewing subscription plans. Subscription prices are displayed within the application and may vary by region, currency, taxes, platform rules, promotions, and local requirements.

Payment will be charged through your Apple App Store or Google Play account at the time of purchase. Subscriptions automatically renew unless canceled before the end of the current billing period. You may manage or cancel subscriptions through your Apple App Store or Google Play account settings.

Deleting your Caloblock account or uninstalling the app does not automatically cancel an active subscription. Refunds, credits, and billing disputes, if available, are governed by the policies of the platform through which the purchase was made. We reserve the right to modify subscription pricing, features, trials, promotions, or offerings at any time, subject to applicable laws and platform requirements.

4. Permitted Use and Acceptable Use

You agree to use Caloblock only for lawful, personal, and permitted purposes. You agree not to:

• Use Caloblock for illegal, harmful, fraudulent, abusive, or misleading purposes
• Attempt to gain unauthorized access to accounts, systems, data, infrastructure, or services
• Interfere with, reverse engineer, scrape, overload, disrupt, or compromise Caloblock
• Circumvent subscriptions, security measures, app-blocking tools, or access controls
• Upload content that infringes rights, violates law, or contains malicious code
• Use Caloblock in emergency, medical, life-critical, or safety-critical situations

5. AI-Generated Content Disclaimer

Caloblock may use AI systems to generate calorie estimates, food analysis, nutritional insights, fitness recommendations, workout suggestions, app-related guidance, and other outputs. AI-generated information may be inaccurate, incomplete, outdated, biased, or incorrect.

You must independently verify important information before acting on it. AI outputs should never be treated as medical, dietary, nutritional, fitness, healthcare, legal, financial, or other professional advice.

6. Health, Nutrition, Medical, and Calorie Disclaimer

Caloblock is not a medical service and does not provide medical, dietary, nutritional, fitness, healthcare, or professional advice. Calorie estimates, macronutrient estimates, food analysis, and nutrition information are approximations provided for general informational purposes only.

You are solely responsible for your own health, nutrition, diet, food consumption, lifestyle choices, and decisions made based on app content. Consult qualified healthcare professionals before making health, fitness, nutritional, dietary, weight-management, or medical decisions.

7. Allergy and Food Safety Disclaimer

Caloblock cannot guarantee the accuracy of ingredient identification, allergen detection, food recognition, calorie calculations, nutrition information, or food safety information. You are solely responsible for verifying ingredients, allergens, preparation methods, labels, warnings, and food safety information before consuming or preparing any food.

Caloblock is not responsible for allergic reactions, food-related incidents, medical complications, injuries, illnesses, damages, or other harm resulting from reliance on information provided by the application.

8. Fitness and Workout Disclaimer

Exercise, activity, and fitness recommendations are provided for general informational purposes only. Physical activity involves risk. You assume all risks associated with exercise, workouts, fitness routines, and lifestyle changes.

Caloblock is not responsible for injuries, health issues, accidents, exercise-related incidents, or damages related to workouts, physical activity, or fitness recommendations.

9. Emergency Disclaimer

Caloblock is not intended for emergency, medical, safety-critical, or life-critical situations. If you believe you may have a medical emergency or require urgent assistance, contact qualified medical professionals or emergency services immediately.

10. App Blocking and Productivity Features

Caloblock provides productivity and application management features, including the ability to restrict access to selected applications. The availability and effectiveness of these features may vary depending on device type, operating system version, platform restrictions, user permissions, and system updates.

We do not guarantee uninterrupted operation or complete effectiveness of app-blocking features under all circumstances. You are responsible for configuring permissions, device settings, app selections, and platform controls correctly.

11. Intellectual Property

Caloblock, including its software, design, branding, logos, graphics, interfaces, text, workflows, features, and content, is owned by Ofri Cohen or applicable licensors and is protected by intellectual property and other laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Caloblock except as expressly permitted by law.

12. User Content

You retain ownership of content you submit to Caloblock, subject to the rights needed for us to operate the service. You grant Caloblock a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, display, analyze, and use your submitted content as necessary to provide, secure, support, and improve the application.

13. Warranty Disclaimer and No Guarantee of Accuracy

Caloblock is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, title, and non-infringement.

We do not guarantee the accuracy, completeness, reliability, or suitability of calorie estimates, food recognition results, nutritional information, workout recommendations, AI-generated content, app-blocking functionality, subscriptions, recommendations, or other information provided through the application.

We do not guarantee that the application, AI systems, calorie calculations, nutrition information, food analysis, app-blocking functionality, subscriptions, recommendations, or services will be accurate, complete, secure, uninterrupted, timely, or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, Caloblock and Ofri Cohen shall not be liable for any direct, indirect, incidental, special, consequential, punitive, exemplary, or other damages arising from or related to your use of, inability to use, or reliance on Caloblock.

This includes but is not limited to damages related to health-related decisions, food consumption, allergic reactions, food-related incidents, medical complications, injuries, exercise-related incidents, inaccurate AI outputs, calorie estimates, nutrition information, data loss, business interruption, subscription issues, device issues, service unavailability, or decisions made based on app content.

15. Indemnification

You agree to defend, indemnify, and hold harmless Caloblock and Ofri Cohen from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to your use of Caloblock, your content, your violation of these Terms, your violation of law, or your infringement of any rights of another person or entity.

16. Force Majeure

We are not responsible for delays, interruptions, failures, service outages, data transmission issues, or performance problems caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, infrastructure failures, cyberattacks, governmental actions, platform provider issues, or third-party service disruptions.

17. Account Suspension and Termination

We may suspend, restrict, or terminate access to Caloblock at any time if we believe you violated these Terms, created risk or liability, misused the service, failed to comply with applicable law, or engaged in conduct that may harm users, Caloblock, platforms, or third parties.

You may stop using Caloblock at any time and may request account deletion through the app where available or by contacting support. Termination does not automatically cancel subscriptions managed through Apple App Store or Google Play.

18. Governing Law, Jurisdiction, and Platform Rules

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Israel.

Your use of Caloblock may also be subject to Apple App Store, Google Play, Google Sign-In, Apple Sign-In, and other third-party platform terms, policies, and requirements. If platform terms conflict with these Terms, the platform terms may control solely with respect to your relationship with that platform.

19. Changes to These Terms

We may modify these Terms from time to time. Updated Terms will be posted in the app or on our legal pages. Continued use of Caloblock after changes become effective constitutes acceptance of the revised Terms.
